Can I seek abortion as a woman with disabilities?
Abortion is a healthcare service, and is available to all pregnant persons irrespective of dis/abilities.
Women with major physical and/or intellectual disabilities as per criteria laid down under the Rights of Persons with Disabilities Act, 2016, can seek abortion up to 24 weeks. Beyond 24 weeks, permission of the court is required, except where there is a threat to the life of the pregnant person, and/or where significant foetal abormalities have been detected.
In case of intellectual disabilities and/or the pregnant person is a minor, the consent of one's parent or guardian is required in writing.
