Can I seek abortion if I have separated from my boyfriend/partner/spouse?
Abortion can be sought where any kind of relationship between the pregnant person and their partner changes and makes the ongoing pregnancy unwanted.
It can be sought on the basis of failure of contraception - irrespective of the nature of the relationship.
Between 20 to 24 weeks, abortion can be sought in case the marital relationship changes during pregnancy (widowhood, or divorce).
While the law has not been amended, courts have also allowed abortion in a few select cases where there are changes in non-marital relationships (such as breakup, desertion, or false promise of marriage). One might need to approach the appropriate High Court in such cases.
