What rights do women living with HIV have under the law?
Apart from the general protections that all protected persons have under the law (including non-discrimination, confidentiality, and informed consent requirements), women living with HIV have certain other rights, including to:
- Reside and participate fully in a shared household;
- Receive government-provided counselling and information on HIV treatment and pregnancy outcomes;
- Refuse sterilisation or abortion, which cannot be performed without her informed consent;
- Protection from partner notification or duty-to-disclose obligations where disclosure could lead to violence or harm.
