Can I seek abortion if I have separated from my boyfriend/partner/spouse?
Abortion can be sought where any kind of relationship between the pregnant person and their partner changes and makes the ongoing pregnancy unwanted.
It can be sought on the basis of failure of contraception - irrespective of the nature of relationship.
Between 20 to 24 weeks, abortion can be sought in case marital relationship changes during pregnancy (widowhood, or divorce). Where there are changes in non-marital relationships (such as breakup, desertion, or false promise of marriage), the courts have allowed abortion in a few select cases.
