Can someone disclose my HIV status without my permission?

Any person who has received information regarding an individual's HIV status in confidence, including a friend or co-worker, is not permitted to disclose that information without the individual's informed consent.

HIV-related information about a person with HIV can only be disclosed without their informed consent in the following situations:

  1. If a court orders it in the interest of justice,
  2. In a court case where it is necessary for filing a lawsuit or for legal proceedings,
  3. By healthcare providers to other healthcare providers for treatment, or the partner,
  4. In anonymised statistical studies, and
  5. To specific government officials for monitoring and supervising HIV/AIDS programmes.
