The Act provides for penalties in the following situations:

• Propagating hatred or discrimination against protected persons;
• Breach of confidentiality regarding HIV status in legal proceedings;
• Failure to comply with an Ombudsman's order;
• Victimisation of any person for filing a complaint, appearing as a witness, or participating in proceedings under the Act.
