Am I legally required to disclose my HIV status to anyone?
No, you are not legally required to disclose your HIV status. The only exception is if a court specifically orders you to disclose it because it is necessary for a case being heard before it.
However, if you are HIV-positive and are aware of how HIV is transmitted or have been counselled about it, the law expects you to take all reasonable precautions to prevent passing it on to others. This may include:
- Using condoms during sexual contact; or
- Avoiding sharing needles or syringes used for injecting drugs, as sharing such equipment between an HIV-positive person and an uninfected person is a known route of HIV transmission; or
- Informing your partner of your HIV status before sexual contact.
